A three-judge panel of the U.S. Circuit Court of Appeals for the District of Columbia came to the right decision Friday by unanimously rejecting a lawsuit by two states that want to ship their high-level nuclear waste to Yucca Mountain 90 miles northwest of Las Vegas. South Carolina and Washington, with backing from the Nuclear Energy Institute, sued because they don't like the fact the Energy Department wants to withdraw its license to build a permanent dump in the Nevada desert.But the court determined the lawsuit was premature because the Nuclear Regulatory Commission should be given the opportunity to either rule on the Energy Department's request or make a decision on the license application if it proceeds.
